Users can utilize various proprietary automated algorithms (“AA or service(s)”) offered by BLSH, which is an independent third party in executing their trades by filling in the trading parameters in respect of the chosen AA. The operation of the AA is dictated by the parameters set by the user. No AA has the ability to exercise any discretion with regard to any trade position without the input of the user. A user may stop the operation of the AA at any time, and withdraw all cryptocurrency and stocks involved, including principal and realized profit or loss, at any time.

Nothing contained in this service constitutes investment, legal, tax or other advice. You should not rely on the contents of this service as advice or to make any decision. Before making any trading or investment decision, you should obtain professional advice specific to your circumstances, and obtain and read the terms and conditions and other information relevant to any trade or investment, including risk disclosures pertaining to such trade or investment. BLSH does not make any determination as to the suitability of any trade or investment conducted by way of these services and makes no representation or warranty that any such trade or investment is suitable for you. Any statement of risks of any trade or investment referenced by the services offered by BLSH should not be regarded as a full disclosure of all risks.

By accessing the services provided by BLSH, you acknowledge and agree that BLSH is not responsible for your use of any information that you obtain from these services, that your trading or investment decisions are made on your own for which you bear sole responsibility, and that you use these services and the AA and related services at your sole risk. Also, BLSH shall not be liable for any liability caused by your usage of any information that you obtain from these services.

As a user or potential user of the AA, before you use these services and AA, you should be aware of the following:

1. You should not transact in a cryptocurrency or stock if you are not familiar with that cryptocurrency or stock. Transacting in cryptocurrency or stock may not be suitable for you.Once you transact on the AA, your behavior shall be deemed willingly by yourself, and you shall be deemed to be fully familiar with the cryptocurrency, stock and/or fiat currency.

2. You should be aware that the value of cryptocurrency or stocks may fluctuate greatly. You should buy cryptocurrency or stocks only if you are willing and prepared to accept the risk of losing all of the money you put into such assets.

3. Past performance is not indicative of likely future performance and the value of any cryptocurrency or stock available on the proposed services may go down as well as up. BLSHdoes not guarantee the performance of any trade or investment, the return of any user’s principal or the achievement of any rate of return.

4. Investment by way of the proposed AA and services in any of the offered digital assets carries substantial risk, including the possible loss of principal. And performance and returns of any cryptocurrency or stock may vary significantly over time.

5. Trading and investment in cryptocurrency or stock available by way of the AA and offered services are not suitable for all persons. You should only trade or invest in a cryptocurrency or stock after you have thoroughly reviewed the relevant information of the cryptocurrency or stock. You may wish to consult an independent financial adviser for personal and specific trading and investment advice before entering into any trade.

To the fullest extent permitted by applicable law, you agree to indemnify, hold and defend us, BLSH officers, directors, shareholders, predecessors, successors in interest, employees, agents, clients and partners, harmless from any demands, loss, liability, claims or expenses, made against BLSH by any and all third-party claims and liabilities arising out of or related to or in connection with your use of the AA, Website, related services, Applications and/or Data, including any served content that is not provided by us, or your breach of any term of the Agreement.

You shall notify BLSH immediately of any matter which could result in any loss, claim, damage, expense or liability subject to indemnification under this section. Such notification will not release you from your indemnification duty. BLSH reserves the right to exercise sole control over the defense, at your expense, of any claim subject to indemnification under this section.

BLSH does not promise that our AA, Website or any content, related services, Applications and/or Data or feature will be error-free or uninterrupted, or that any defects will be corrected, or that your use of the Website, Services, Applications and/or Data will provide specific results. The AA, Website and its content, related services, services offered, Applications and/or Data are delivered on an as is and as available basis. All information provided on the Website is subject to change without notice.

BLSH disclaims all warranties, express or implied, including any warranties of accuracy, non-infringement, merchantability, fitness for a particular purpose, quality or performance. BLSHmakes no warranty that the AA, Website, Applications and/or Data will meet your specific objectives or needs. BLSH makes no warranty that the AA, Website, related services, Applications and/or Data will be free from errors or bugs. BLSH makes no warranty that there will be uninterrupted operation of the AA, related services, Website, Applications and/or Data.

BLSH makes no warranty regarding the Data or any other information purchased or obtained through the AA, Website, Applications and/or the related services, or the accuracy, timeliness, truthfulness, completeness or reliability of any Data or other information obtained through the AA, Website, Applications and/or the related services.

You expressly acknowledge that any data downloaded through the use of BLSH’s AA and related services and Website is done at your own discretion and risk, and that you will be solely responsible for any damage to your computer system or loss of applications or data that results from the download of such data.

We disclaim any and all liability for the acts, omissions and any conduct of any third parties in connection with or related to your use of the AA, Website, related services, Applications and/or Data. You acknowledge that we are not a financial institution and do not give or provide you any advice on your trading activity and disclaim any liability for execution of your trading orders. Your sole remedy against us for dissatisfaction with the AA, Website or any its content, related services, Applications and/or Data is to stop using the AA, Website or any such content, related services, Applications and/or Data.

The above disclaimer applies to any damages, liability or injuries caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction of or unauthorized access to, alteration of, or use, whether for breach of contract, tort, negligence or any other cause of action.

No claim for a breach of any our representation or warranty shall be actionable or payable if the breach in question results from or is based on a condition, state of facts or other matter which was disclosed to you and/or actually known by you.

In no event will BLSH be liable for any indirect, special, incidental, consequential or punitive loss, injury or damage of any kind (regardless of whether BLSH has been advised of the possibility of such loss) including, but not limited to, any loss of revenue, income or profits, loss of use or data, or damages for business interruption, any damages resulting from any interruption or disruption in AA, communications or Services or Applications, unavailability or inoperability of the Services, Applications and/or Data. BLSH’s liability arising under this Agreement, whether in contract, tort (including negligence) or for breach of statutory duty or in any other way shall only be for direct damages and shall not exceed US $1,000.

The provision of this section determines the allocation of risks between you and BLSH, and you agree and acknowledge that such allocation of risks and the limitations of liability specified herein are an essential basis of the bargain between you and BLSH.

The above exclusions of liability shall be valid to the fullest extent permitted by law. Some jurisdictions do not allow the exclusion of certain warranties in certain circumstances. Accordingly, some of the limitations set forth above may not apply.
